Now, the judges’ performance will go under scrutiny in India. The Union Cabinet has given green signal to Judges (Inquiry) Bill on Thursday. The government’s main aim behind the approval of the bill is to make judiciary more accountable.
The Bill has proposed some amendments to the Judges (Inquiry) Act of 1968. Under the new law, any person would be able to make a complaint to the National Judicial Council (NJC) against judges. However, the Chief Justice of India (CJI) would be excluded from the procedure.
The NJC will be assigned the authority to see the complaints of misconduct filed against judges of the Supreme Court and High Courts by the people.
The NJC will prepare the code of ethics for judges. The declaration of assets at the time of appointment as a judge and every year thereafter until retirement will be included in the code of ethics.
Earlier, the bill was introduced during last year’s winter session in Parliament. Because of different voices from judiciary, it could not be passed.
According to the new law, if the judge found guilty, he or she could be removed from the post easily. Currently, removing any judge requires a complex process of impeachment.
