Delhi HC rejects Kohli's plea against extradition to UK

The Delhi High Court has dismissed the review petition filed by Maninder Pal Singh Kohli, accused in Hannah Foster rape case in UK, in which he had challenged his extradition to UK.

Now, with the court’s order, the way to extradite Maninder Pal Singh Kohli to Britain has been cleared. Kohli has been accused of raping and killing teenager Hannah Foster in UK Police recovered the body of girl, Kohli fled to India. He was arrested in India in 2004.

In India, Kohli had repeatedly challenged his extradition to Britain by saying that he was innocent. He argued that he would not get a fair trial in the case because of UK is biased against the people of Asian community.

The Division Bench of Delhi High Court comprising Justice Mukul Mudgal and Justice P. K. Bhasin said that Kohli is unnecessarily delaying the extradition process.

The court also rejected Kohli’s claim that he would not get fair trial in UK because of biasness against Asian community. The Bench asked him:

If there is any bias, then why you go to the United Kingdom. You enjoyed the British working condition. Why this sudden fascination to the Indian court.

The bench said further:

Mr Kohli must go back to England and face charges in connection with this “very heinous crime”.

The latest appeal was lodged on Monday only days after Mr Kohli lost a previous appeal against extradition at India’s Supreme Court. At the same time, the apex court had said in the matter that Kohli would not be awarded death penalty even if he was found guilty after the trial in United Kingdom.

According to the report, Ms Hannah Foster, 17, was abducted near her home in Portswood on in Southampton on 14 March, 2003 and murdered. The Police recovered her body after two days.

The post-mortem report confirmed that she had been raped and strangled. Kohli left the country for India when his name came out as a suspect in this case after inquiry. Later, the West Bengal Police arrested him near the Nepal border more than a year after leaving the UK.
